Copeland Roberts Auction House ("Copeland Roberts," "we," or "us") provides auction services for numismatic items and collectibles. By registering, consigning, or bidding, you ("Bidder") agree to these Terms and Conditions.

1. Definitions


Auction House
Copeland Roberts Auction House.

Bidder
An individual or entity bidding to purchase items.

Buyer’s Premium
An additional fee payable by the winning Bidder, typically 22% (includes GST where applicable).

Carrier
Any third party responsible for transporting purchased Goods or Auction Items from our Premises to customers.

Consignor
An individual or entity submitting items for sale.

Goods
The coins and any other products that Copeland Roberts advertises and/or makes available for sale and sold to the Buyer whether by Auction or otherwise.

Hammer Price/Sale Price
The final bid accepted for a Lot before fees.

Increment Table
A schedule of bidding increments based on the current bid value.

Live Online Auction
Auctions conducted in real-time through an automated online bidding system.

Lot
An individual item or group of items auctioned as a unit.

Premises
Our place of business, located at 27–39 Abercrombie Street, Chippendale, NSW, 2008, Australia.

Reserve Price
The minimum price acceptable for a Lot.

Auctioneer
Copeland Roberts, acting as the operator of its auctions.

Insurance Premium
An optional charge equal to 2% of the invoice total, payable by the Buyer if they elect to insure their Goods in transit.


2. Registration


2.1 All participants must register before bidding and must provide accurate and complete contact information, identification, and any supporting documents requested.

2.2 Copeland Roberts reserves the absolute right to approve, deny, suspend, or revoke registration at its sole discretion, without obligation to provide reasons.

2.3 Registration constitutes acceptance of these Terms and Conditions in full.

2.4 Registrants must be at least 18 years of age.

2.5 Copeland Roberts reserves the right to:

request additional references, proof of funds, deposits, or credit checks;

verify identity through third-party providers; and

delay or deny registration until such verification is completed.

2.6 Copeland Roberts may, at its sole discretion, require a refundable deposit prior to granting bidding privileges. This deposit will be applied to any successful purchases or refunded in full if no purchases are made.

2.7 Any registrant who provides false, misleading, or incomplete information may have their registration cancelled immediately and may be reported to relevant authorities and trade organisations.


3. Bidding Process


3.1 Highest Bidder: The highest bidder acceptable to the Auctioneer shall be the Buyer. Disputes regarding the highest bidder will be resolved at the Auctioneer's sole discretion, including re-offering the Lot.
3.2 Bidding Regulation: The Auctioneer has absolute discretion to regulate bidding, refuse bids, or advance the bidding as it sees fit.
3.3 Absentee and Identical Bids: The starting price will be the Reserve Price. Identical bids are prioritised by earliest submission.
3.4 Bid Retraction: Absentee bid retraction is allowed only for valid reasons with sufficient evidence and solely at the Auctioneer's discretion.
3.5 Auctioneer Rights: The Auctioneer may withdraw Lots or act on behalf of clients as it sees fit.
3.6 Errors: The Auctioneer is not responsible for errors in bidding, technical failures, or disruptions.


4. Buyer’s Obligations


4.1 The successful Bidder agrees to pay the Hammer Price plus:

Buyer’s Premium (22% including GST).

A 2.5% surcharge for credit or debit card payments, which applies to the total invoice amount.

4.2 Payments are due within 7 days of invoice issuance. Invoices will be issued via email within 48 hours of the close of the auction. Buyers must contact Copeland Roberts within three business days if they cannot access their invoice.

4.3 Accepted payment methods:

Bank transfer (details provided on the invoice).

Credit/debit card (surcharges apply).

4.4 The Buyer is solely responsible for ensuring payment funds are sent to the correct account as shown on the invoice.

4.5 Late payments will accrue interest at 2% per month (compounding) and may result in forfeiture of Lots or resale. All reasonable costs associated with resale, including deficiencies, legal fees, and recovery costs, will be borne by the defaulting Buyer.

4.6 Should a Buyer fail to pay within 7 days, Copeland Roberts reserves the right to take legal proceedings, engage a debt collection agency, and/or charge the credit card on file the total amount owing (or instalments) at Copeland Roberts’ discretion.

4.7 Defaulting Buyers will be permanently blocked from future Auctions. Copeland Roberts may share the name and email address of defaulting Buyers with third-party auction houses and/or relevant trade organisations such as ANDA (Australian Numismatic Dealers’ Association), for fraud prevention purposes.


5. Ownership and Delivery


5.1 Ownership of Goods does not pass to the Buyer until full payment in cleared funds has been received.
5.2 Goods will be delivered by Copeland Roberts’ chosen method, normally via Australia Post, charged at a flat $15 fee regardless of the number or size of purchased Goods.
5.3 Buyers are solely responsible for providing an accurate delivery address. Copeland Roberts waives all liability for loss or delay due to incorrect or incomplete address details.
5.4 A tracking number will be provided as proof of shipment.
5.5 All Goods are insured while in storage at Copeland Roberts’ premises. Buyers may elect to insure their Goods in transit to their nominated address for a premium of
2% of the invoice total. Insurance is optional and must be requested in writing by email prior to invoice payment.
5.6 Where insurance is elected, the Insurance Premium will be added to the invoice and must be paid in full.
5.7 Goods shipped without insurance are shipped entirely at the Buyer’s risk. Copeland Roberts waives all liability for loss, theft, or damage of purchased Goods in transit where the Buyer has not elected to purchase insurance.
5.8 Copeland Roberts is not liable for customs charges, seizure, or investigations relating to shipment.
5.9 Buyers may collect Goods in person with 48 hours’ notice, provided payment has been received in full. No shipping or insurance charges apply to collections.


6. Representations and Warranties


6.1 Goods are sold with all faults, imperfections, and errors of description.

6.2 Copeland Roberts guarantees the authenticity of all Goods sold, without time limitation. Nothing in this clause excludes or limits rights under the Australian Consumer Law (ACL).

6.3 Descriptions, images, and condition reports are provided as opinions and guides only, not guarantees. Every Buyer must rely on their own judgment.

6.4 Copeland Roberts does not accept responsibility for grading opinions of third-party services (PCGS, NGC, PMG).

6.5 Items submitted to PCGS, NGC, or PMG that are deemed counterfeit may be returned within one year of the auction date. Refunds will be issued for the Hammer Price only. Authentication and shipping costs remain the Buyer’s responsibility.

6.6 Refunds under Clause 6.5 are limited to authenticity disputes only. The Buyer’s sole and exclusive remedy is a refund of the Hammer Price. Copeland Roberts is not liable for premiums, shipping, or incidental costs.

6.7 Where Goods have been made available for inspection prior to the auction (either in person or by way of a condition report), Buyers are deemed to have had the opportunity to examine them. By bidding, Buyers waive any right to raise objections or claims in relation to issues that a reasonable inspection would have revealed.

6.8 Copeland Roberts agrees to provide condition reports on request.

6.9 Any request for a condition report must be made prior to the close of bidding. Buyers who fail to request a report in advance shall not later rely on the absence of such a report as grounds for dispute, cancellation, or refund.

6.10 No post-auction disputes regarding the physical condition, grade, or quality of Goods will be entertained where the Buyer did not request a condition report or inspection prior to bidding.


7. Termination and Cancellation


7.1 Copeland Roberts may cancel purchases prior to dispatch in cases of error, suspected fraud, misdescription, or non-payment.
7.2 If purchases are cancelled prior to dispatch, the Buyer will be refunded any monies paid.
7.3 If Goods are materially below the standard described, Copeland Roberts may provide an exchange or refund.
7.4 All bids placed are final and cannot be revoked.


8. Limitations of Liability


8.1 To the maximum extent permitted by law, Copeland Roberts accepts no liability for any direct or indirect loss or damage, including consequential or exemplary damages, arising from Auctions or use of the Website.
8.2 Legal claims must be filed in New South Wales and governed by its laws.
8.3 Nothing in these Terms excludes, restricts, or modifies any rights under the Australian Consumer Law (ACL) that cannot be excluded, restricted, or modified.


9. Force Majeure


9.1 Copeland Roberts is not liable for failure to perform contractual obligations caused by events outside of its reasonable control (“Force Majeure Events”).
9.2 Obligations are suspended for the duration of the Force Majeure Event, with additional time to perform obligations thereafter.
9.3 Copeland Roberts will take reasonable steps to mitigate the effects of Force Majeure and resume normal operations as soon as possible.


10. Privacy, Data Protection and Communications


10.1 Personal information is collected solely for auction operations, including registration, bidding, payment processing, and fraud prevention. In cases of non-payment or fraud, Copeland Roberts may share Buyer information with third-party auction houses or relevant trade organisations.
10.2 Personal data is retained only as long as necessary to fulfil auction-related activities or as required by law.
10.3 All notices/communications must be made by phone (02 8318 9782) or email (contact@copelandroberts.com).
10.4 Notices are deemed received on the next business day if sent on a weekend or public holiday.
10.5 Copeland Roberts may send you information about our services. You may opt out by contacting us.


11. Amendments and General Provisions


11.1 Copeland Roberts may amend these Terms and Conditions. Updates take effect upon posting or email notification.
11.2 If any provision is invalid or unenforceable, it shall be modified to the minimum extent necessary. If not possible, it will be deemed deleted. The remainder continues in effect.
11.3 These Terms constitute the entire agreement between you and Copeland Roberts.
11.4 No third-party rights are conferred under these Terms.
11.5 These Terms are governed by the laws of New South Wales.


12. Final Acknowledgment


By registering, bidding, or consigning with Copeland Roberts Auction House, you confirm that you have read, understood, and agreed to these Terms and Conditions.

The Seller wishes to consign Goods to Copeland Roberts to market and sell on their behalf.
The Seller agrees to these Terms & Conditions when signing or electronically accepting a Consignment Form.

1. Agreed Terms


1.1 These Terms and Conditions apply to all Goods consigned to Copeland Roberts for sale.
1.2 “Agreement” means the signed/e-accepted Consignment Form together with these Terms, in that order of precedence.
1.3 Definitions include: Advance Payment, Auctioneer, Business Day, Buyer, Commission, Consignment Form, Facility, Force Majeure Event, Goods, Guarantee Price, Insurance Value, List Price, Reserve Price, Sale Price, Seller.


2. Agency and Consignment


2.1 The Seller appoints Copeland Roberts as exclusive agent to market and sell the Goods during the Term. The sale contract formed on a successful bid is between Seller and Buyer; Copeland Roberts acts as the Seller’s agent.
2.2 Goods consigned are subject to these Terms upon acceptance.
2.3 The Parties may enter multiple Consignment Forms; each forms a separate Agreement.
2.4 During the Term, the Seller must not market or sell the Goods directly or indirectly, nor request their return, except as permitted herein.
2.5 Copeland Roberts may conduct AML/CTF screening, sanctions checks and proof-of-title enquiries, and may refuse or suspend a consignment if not satisfied.


3. Catalogue Descriptions and Images


3.1 Catalogue descriptions are guides only. Absence of condition notes does not imply fault-free Goods.
3.2 Images are illustrative, not to scale, and not definitive of colour or condition.
3.3 The Seller grants Copeland Roberts a perpetual, royalty-free licence to photograph, film and reproduce images and descriptions of Goods for catalogues, digital media, PR, archives and educational use. Copeland Roberts owns copyright in new catalogue text and images it creates.


4. Auction Dates and Changes


4.1 Copeland Roberts determines auction scheduling, format and type.
4.2 Sellers will be informed of final auction details in their Seller Statement.


5. Authenticity, Title and Warranties


5.1 The Seller warrants:
(a) Goods are authentic and accurately described to the best of their knowledge;
(b) they are the sole legal owner, free of encumbrances; and
(c) Goods are not counterfeit, stolen, illicitly obtained or subject to export/import restrictions.
5.2 Copeland Roberts may obtain expert opinions (e.g., PCGS, NGC, PMG) at Seller’s expense where authenticity is in doubt (with prior notice where practical).
5.3 If a sale is rescinded or refunded due to inauthenticity, lack of title, misdescription or illegality, the Seller must within 7 days repay all sums received for that Lot (including any Advance Payment) and indemnify Copeland Roberts for amounts refunded to the Buyer (including buyer’s premium), reasonable legal costs, shipping and related expenses.
5.4 Copeland Roberts may set-off any sums due from the Seller under this Agreement against amounts otherwise payable to the Seller.


6. Reserves and Estimates


6.1 Copeland Roberts will recommend List Prices and Reserves.
6.2 The Seller sets final Reserves, but Copeland Roberts may reject Goods if reserves are unreasonably high.
6.3 Guarantee Prices may be agreed in writing; Copeland Roberts may protect reserves/guarantees by bidding on the Seller’s behalf up to that level.
6.4 Requests to increase a Reserve within 21 days of the auction may incur a 10% service fee on the new reserve, and Copeland Roberts may revise lotting/placement accordingly.
6.5 Any written agreement on List Price, Reserve or Guarantee (including emails) supersedes prior indications.
6.6 Where Copeland Roberts determines, in its sole discretion, that Goods carry a low estimate of $150 or less:
– such Goods will either be sold without a reserve; and
– Copeland Roberts may, at its sole discretion, group such Goods to create a Lot above that threshold.


7. Sale of Goods


7.1 Goods may be sold by auction, re-auction, private treaty, digital marketplace or direct sale, provided not below Reserve. Starting prices are indicative only.
7.2 If a Buyer defaults, the Seller authorises Copeland Roberts to:
(a) offer the Goods to the underbidder at their last bid;
(b) sell privately at not less than the underbidder’s last bid;
(c) re-auction; or
(d) return the Goods.
7.3 Payment to the Seller will only be made from cleared funds actually received from the Buyer (or replacement Buyer).
7.4 Sellers and their agents are prohibited from bidding on their own Goods. Copeland Roberts may cancel such a sale and retain proceeds.


8. Unsold Goods and Storage


8.1 Unsold Goods may be re-offered with Copeland Roberts’ consent or returned to the Seller.
8.2 If re-offered, Reserves must normally be reduced by 35% from the prior auction.
8.3 Unsold Goods must be collected or consigned for re-sale within 30 days of notice; thereafter storage fees of AUD [$20] per lot per week (or part) may apply.
8.4 If Goods remain uncollected for 60+ days after notice, Copeland Roberts may, after 14 days’ further notice, sell the Goods at no reserve to recover storage/charges, remitting any balance (if any) to the Seller.


9. Payments


9.1 Seller receives the Hammer Price less Commission (normally 10%) and agreed fees.
9.2 Commissions/fees are exclusive of GST unless stated otherwise; GST (if applicable) is added at the prevailing rate.
9.3 Payment to Seller is within 30 days of receipt of cleared funds from the Buyer.
9.4 Guarantee Price: if agreed, the Seller is paid the Guarantee Price (less Commission), even if Sale Price is lower.


10. Advance Payment


10.1 No Advance Payment unless stated in the Consignment Form.
10.2 If paid, Advance Payments are repayable if Goods are withdrawn or a sale is rescinded under Clause 5.3 or Clause 19.


11. Withdrawals


11.1 Goods cannot normally be withdrawn within 42 days of the scheduled auction.
11.2 If withdrawn in that period, the Seller pays 15% + GST of the high estimate plus documented hard costs (photography, catalogue, storage, platform/transport). Copeland Roberts has a lien until paid.
11.3 Copeland Roberts may withdraw Goods at its discretion.


12. Title, Risk and Security


12.1 Risk passes to Copeland Roberts when Goods are delivered to its Facility or collected on its behalf.
12.2 Title remains with Seller until Buyer pays in full.
12.3 Copeland Roberts holds Goods as bailee on Seller’s behalf until title passes.
12.4 Copeland Roberts has a lien over Goods and sale proceeds for any sums owed by the Seller.
12.5 The Seller grants Copeland Roberts a security interest in Goods and proceeds under the PPSA; Copeland Roberts may register and perfect this interest.


13. Insurance


13.1 Copeland Roberts insures Goods under its business policy from the time risk passes until title transfers to Buyer.
13.2 Cover is subject to policy terms, standard exclusions, deductibles and limits.
13.3 Copeland Roberts’ liability for loss/damage is capped at the insurance recovery actually received (less any deductible).
13.4 The Seller waives recourse against Copeland Roberts to the extent loss is covered (or would have been covered) by such insurance and acknowledges the insurer’s right of subrogation.


14. Confidentiality and Marketing Use


14.1 Each party must keep the other’s confidential information secure.
14.2 Permitted disclosures: employees/advisers who need to know, regulators, or as required by law.
14.3 Notwithstanding confidentiality, Copeland Roberts may publish sale results and images (including estimates/hammer) for marketing and market reporting.


15. Limitation of Liability


15.1 Nothing limits liability for death/personal injury caused by negligence, or fraud.
15.2 Each party’s total liability under this Agreement is limited to the lesser of: (a) Insurance Value, or (b) amount actually recovered from the insurer.
15.3 Neither party is liable for indirect or consequential loss (including loss of profit, goodwill or opportunity).


16. Compliance with Laws and Policies


The Seller must comply with all applicable laws and warrants the Goods are not subject to cultural heritage/export restrictions or sanctions.


17. Commencement and Term


The Agreement begins on the Commencement Date in the Consignment Form and ends upon sale/return of Goods and settlement of all accounts.


18. Termination


Either party may terminate immediately if the other commits a material breach (not remedied within 5 days), repeatedly breaches, becomes insolvent, or is unable to perform due to a Force Majeure Event lasting 3 months.


19. Obligations on Termination


19.1 Copeland Roberts will return unsold Goods (subject to lien).
19.2 The Seller must repay any Advance Payments for unsold Goods within 10 Business Days.
19.3 Copeland Roberts may withhold Goods until repayment is made.
19.4 If not repaid, Copeland Roberts may set the Reserve Price = Advance Payment + Commission and sell accordingly (after notice).
19.5 Rights accrued at termination survive; so do provisions intended to survive.


20. General Provisions


20.1 Force Majeure suspends obligations; if > 120 days, either party may terminate on 14 days’ notice for affected Goods.
20.2 Rights are cumulative, not exclusive.
20.3 Relationship: nothing creates partnership or joint venture.
20.4 Assignment: neither party may assign without consent.
20.5 Entire Agreement: supersedes prior understandings.
20.6 Variation: only in writing signed by both parties.
20.7 Waiver: must be in writing; no delay waives rights.
20.8 Severance: invalid terms are severed; remainder continues.
20.9 Notices: in writing to Copeland Roberts, Shop 2, 27–39 Abercrombie Street, Chippendale NSW 2008, or contact@copelandroberts.com; by personal delivery, courier, express post or email. Deemed receipt: personal—when delivered; post—9:00am on 2nd Business Day after posting; courier—on signed receipt time; email—1 Business Day after transmission.
20.10 Mediation: before commencing proceedings (other than urgent relief), parties must attempt mediation in Sydney, NSW administered by an agreed mediator, sharing mediator fees equally.
20.11 Governing Law: New South Wales law; NSW courts have exclusive jurisdiction.


21. Seller Acknowledgment


By consigning Goods, the Seller confirms they have read, understood and agree to these Terms.


22. Amendments


Copeland Roberts may update these Terms with written notice; updates apply to future consignments.
